Requirements for participating:

• The prize draw is initiated by Swedish Match North Europe AB, Sveavägen 44, 118 85 Stockholm, Sweden (“Swedish Match”, “us” or “we”), for the purpose of marketing Swedish Match products within Austria and subject to these Terms & Conditions a participation in the prize draw is only possible, if the Participant accepts these Terms & Conditions.
• The prize draw is only open for nicotine users aged 18 years or older who is Austrian residents.
• Swedish Match (or group companies to Swedish Match) employees, consultants or other persons involved in the administration or conduct of this prize draw may not participate.

How it Works

• The promotion including the prize draw will start on 12 October 2023, and finish on the closing date of 27 November 2023. After the closing date, no further Participants will be accepted for the prize draw.
• This promotion is targeted at nicotine users. To enter the prize draw, the Participants have to (i) follow (thunder_europe) Instagram and (ii) like the giveaway post on (thunder_europe).
• Participants acknowledge that any personal data processed in connection with the promotion will be processed in accordance with Swedish Match’s Privacy Notice, which is available at thundernp.com/en/privacy-policy/
• Each Participant may only enter the prize draw once. Any Participants that participate multiple times will be disqualified entirely.
• After the closing date, one (1) winner will be selected at random using an automated computer process that produces verifiably random results among all Participants that have fulfilled above terms. The prize is an iPhone 15 Pro (128GB Black). Swedish Match’s selection of winners is final and binding, and no correspondence on the selection process will be entered into.
• The winner will be notified within 1 days from the closing date on 27 November 2023 by Instagram direct message and Swedish Match will request the winner to verify age, full name, phone number and mailing address. If the winner does not respond to this request within 5 days from the date of Swedish Match’s direct message, Swedish Match reserves the right to withdraw the prize and select another winner using the automated computer process described under 8. The prize will be delivered to the winner at the mailing address notified at the time of claiming the prize. The winner must receive the prize personally and provide an official ID to verify that he/she is over 18. If the prize cannot be delivered to the mailing address notified by the participant or if the winner fails to verify his/her age, Swedish Match can use its right to withdraw the prize.
• Participants may not request an alternative prize or cash, if they have been chosen as a winner. The winner may not transfer the prize to any third party. Swedish Match will not reimburse any costs which the winner incurs as a result of or in connection with the prize.
• If the prize is no longer available on the market, or unavailable for other reasons, Swedish Match may replace the prize with a prize of equivalent value. Participants will be informed as soon as reasonably possible of such a change. They are not entitled to any claims as a result of such substitution.

Other

• Swedish Match may, in its sole discretion, change these Terms & Conditions without prior notice and suspend the prize draw for a temporary period or cancel it at any time. This shall not give rise to any claims against Swedish Match. The current version of the Terms & Conditions is made available online.
• Participants have no legal claim to participate in the prize draw or in relation to the conduct of the prize draw. Swedish Match does not have any liability for technical downtime or disruptions, which prevent participation in the prize draw.
• Swedish Match will be liable for damages if the damage has been caused intently or gross negligently or if physical injury has been directly caused by this prize draw. Swedish Match is not liable for any other and in particular slightly negligent breaches of obligations under these Terms & Conditions. Especially, Swedish Match will not be liable for any inconveniences, taxes, costs or loss of profits or goodwill resulting from the prize draw or redemption of the prize. Swedish Match will not be liable for: (i) any loss or damage caused by a third party who is not acting on behalf of or under the direct instructions of Swedish Match or, (ii) any damage occurring as a result of the winner using the prize.
• Consumption of THUNDER nicotine pouches is not recommended during pregnancy or nursing or for people with a history of cardiovascular disease. Warnings on the packaging of Thunder nicotine pouches must be observed.
• These Terms & Conditions are governed by the substantive laws of Austria (without regard to any conflict of laws rules). Should any provision of these Terms & Conditions be invalid, or a matter left unregulated, this shall not affect the validity of the remaining provisions. The invalid or incomplete provision shall be replaced, if available, by a corresponding statutory provision under Austrian law.
